Abstract
2018 m. lapkričio 25 d. Kerčės sąsiauryje įvyko incidentas tarp Rusijos federacijos ir Ukrainos, kai Rusijos federacija sulaikė ir areštavo 3 Ukrainos karo laivus (vilkiką „Yany Kapu“ ir du mažus šarvuotuosius artilerijos katerius „Berdiansk“ ir „Nikopol“) ir 24 jų įgulos narius.
Iš pažiūros toks elementarus incidentas pasirodė esąs labai kompleksiškas, todėl siekiant atsakyti į klausimą, ar Rusijos federacija 2018 m. lapkričio 25 d. incidento Kerčės sąsiauryje metu, panaudodama karinę jėgą prieš Ukrainos karo laivus, pažeidė Jūrų teisės konvencijos nuostatas, magistrinio darbo metu buvo atlikta tarptautinės teisės normų analizė, t. y., išanalizuotas Kerčės sąsiaurio statusas, tranzitinio plaukimo turinys, taikaus plaukimo turinys, karinės jėgos naudojimo pagrindai.
Buvo atlikta išsami 2003 m. Rusijos Federacijos ir Ukrainos Respublikos sutarties dėl laivybos Azovo jūroje ir Kerčės sąsiauryje analizė, siekiant įvertinti jos statusą, reguliavimo dalyką. Nustatyta, kad šia sutartimi Azovo jūra ir Kerčės sąsiauris yra įtviritnti kaip Rusijos Federacijos ir Ukrainos Respublikos vidaus vandenys. Autoriaus vertinimu, toks Azovo jūros ir Kerčės sąsiaurio paskelbimas vidaus vandenimis yra nepagrįstas Jungtinių tautų jūrų teisės konvencijos nuostatomis, tačiau atsižvelgiant į tai, kad nėra aiškiai apibrėžta kas gali būti laikoma istoriniais vandenimis, ilgą laiką nevykdomas JTO Generalinės Asamblėjos 1959 m. pavedimas dėl istorinių vandenų apibrėžimo, kitos valstybės tyliai pritarė Azovo jūros paskelbimui Rusijos Federacijos ir Ukrainos Respublikos vidaus vandenimis, darytina išvada, kad Sutarties nuostatos iš esmės neprieštarauja tarptautinės teisės normoms.
Taip pat buvo išanalizuotas Tarptautinio jūrų teisės tribunolo sprendimas byloje dėl trijų Ukrainos karo laivų sulaikymo (Ukraina vs Rusijos federacija). Tyrimo metu nustatyta, kad Ukraina nuosekliai vykdė savo teisių gynimą, taikė ikiteisminę ginčų sprendimo procedūrą, iniciajavo arbitražo teismą pagal jūrų teisės konvencijos VII priedą, kreipėsi į Jūrų teisės tribunolą dėl laikinųjų priemonių skyrimo. Tribunolas patenkino Ukrainos prašymą ir paskyrė laikinąsias priemones, tačiau Rusijos federacija jų iki nustatyto termino neįvykdė. 24 Ukrainos karo laivų įgulos nariai buvo išlaisvinti tik daugiau kaip po trijų mėnesių karo belaisvių apsikeitimo metu, o laivai Ukrainai gražinti dar po beveik trijų mėnesių.
Išanalizavus tarptautinės teisės normas, teismų praktiką ir faktinius duomenis, magistrinio darbo metu padaryta išvada, kad Rusijos federacija 2018 m. lapkričio 25 d. incidento metu, kėsindamasi į Ukrainos karo laivų imunitetą irnepagrįstai panaudodama karinę jėgą prieš juos, taip pat juos sulaikydama ir areštuodama, kartu sulaikydama ir areštuodama įgulos narius, pažeidė Jūrų teisės konvencijos nuostatas.

On November 25, 2018 an incident occurred at Kerch Strait between Russian Federation and Ukraine, where the Russian Federation apprehended and arrested 3 Ukrainian warships (a towboat ,,YanyKapu” and two small armored artillery vessels ,,Berdiansk” and ,,Nikopol”) along with 24 crew members.
Seemingly such an elementary incident ended up being extremely complex, therefore to answer the question whether Russian Federation violated the regulations of the Convention on the Law of the Sea by using military force against Ukrainian warships on November 25, 2018 in the Kerch Strait, the analysis on International Law regulations was done in this Master’s thesis, i.e. analyzed the status of Kerch Strait, content of transit passage, contents of innocent passage, outline of use of military force.
An in-depth analysis of 2003 treaty between the Russian Federation and Ukraine on cooperation in the use of the Sea of Azov and the Kerch Strait was made in order to evaluate its status and regulations. It had been determined that with this treaty the Sea of Azov and the Kerch Strait have been fortified as internal waters of Russian Federation and Ukraine. The author estimates that declaring the Sea of Azov and the Kerch Strait as internal waters is ungrounded on the regulations of the Convention on the Law of the Sea; however since there is a lack of definition of historical waters and for a long time there was a non-compliance with the 1959 UNO General Assembly assignment on the description of historical waters, other countries quietly supported the declaration of the Sea of Azov as internal waters of Russian Federation and Ukraine and a deduction was made that the Treaty regulations go in line with the International Law Standards.
Analysis was also made of the International Tribunal of the Law of the Sea decision involving the apprehension of the three Ukrainian warships (Ukraine vs. Russian Federation). The investigation showed that Ukraine carefully protected their rights, applied before-the-trial conflict resolution procedure, initiated arbitration trial according to the Convention on the Law of the Sea VII annex, addressed the Tribunal of the Law of the Sea about implementing temporary measures. The Tribunal complied with Ukraine’s request and implemented temporary measures, but Russian Federation never executed them by the set date. 24 Ukrainian warship crew members were only released after more than three months during the exchange of the prisoners of war, and the ships were only returned to Ukraine another three months later.
After analyzing the International Law Regulations, trials practice and factual data, the conclusion in this Master’s thesis was made that the Russian Federation, during the incident on November 25, 2018, while threatening the immunity of Ukrainian warships and using unfounded military force against them, while also apprehending the ships and arresting crew members, violated the regulations of the Convention on the Law of the Sea.
